Summary Judgment in Orange County Slip & Fall Case

ABD Partner, Michael Merrill, and Associate, Yolanda Martinez, obtained a summary judgment in favor of a national retailer. The Plaintiff slipped in a substance that had been left by a prior customer and remained on the floor for approximately five minutes. Through discovery, it was ultimately established the Plaintiff had no evidence to show our client had either actual notice or constructive notice of the substance. The Plaintiff ultimately attempted to use the store surveillance footage of the spill and the Plaintiff's fall to create an issue of fact that our client should have known about the substance, but the Court agreed that the Plaintiff's arguments about what the video depicted was an impermissible stacking of inferences. The client is obviously thrilled with the outcome and will be entitled to recover their defense expenses.
