Motion To Dismiss in Polk County

Congratulations to Elif for prevailing on a Motion to Dismiss an AOB lawsuit in Polk County. The Court held that Restoration Plus did not have standing to maintain the lawsuit, as the estimates attached to the Complaint failed to comply with Fla. Stat. 627.7152(2), on the basis that they were supplemental inflated estimates which were not originally attached to the assignments of benefits and as they exceeded the $3,000.00 statutory limit on emergency services.
