Apex Restoration Case Dismissed


Another Dismissal for ASI Preferred and Max Erd!

Apex reported a claim on behalf of a homeowner for a windstorm loss. ASI completed its investigation and issued payment for the replacement of the roofing system. Despite this and Apex actually replacing the roof, Apex proceeded to file suit for an amount substantially higher than the permit valuation for the work performed. Additionally, Apex included “bid” line items in its estimate for various work performed by subcontractors.

During the deposition of Apex' Corporate Representative, Apex refused to identify the subcontractors and the actual cost of the work, claiming trade secret. ASI moved to compel the production of these documents and overrule the claim of trade secret.

The Court agreed with ASI and stated, "Apex Roofing's assertion of the privilege is entirely unsubstantiated". The Court further ordered Apex to produce the documents from its subcontractors within ten days.

Rather than complying with the Court, Apex dismissed the action.
